1. General 

• This website is operated by Artisan & Blooms (US) Limited ("Artisan & Blooms Home Decor"). The website address is artisnandblooms.com and www.artisanandblooms.com
•  By visiting or shopping at this site, including placing an order with an offline order form downloaded from this site, you are agreeing to the terms and conditions set out below. The terms and conditions are subject to change at any time without prior notice. Any such changes will be posted on this page.

 
2. Products or Services
 
•  Products and services referred to on this site are directed solely on the persons accessing the site from the Special Administrative Region of United States & Hong Kong. We make no representation that any products or services referred to on this website are available or appropriate for use in any other location. 
• Any products or services referred to on this site are subject to availability and may be withdrawn at any time without prior notice.
• We reserve the right to decline any order we may, in our opinion, consider unreliable upon having checked the payment details submitted for that particular order or request a payment means of whatever kind which is deemed appropriate.

 
3. Delivery and Charges 

•  We will only affect delivery to United States, Europe & Asia, the New Territories and some designated areas of outlying islands of the Hong Kong Special Administrative Region. To request for overseas delivery, you may email us or call our Customer Service Hotline (852) 3741-0000 during normal business hours. Our Customer Service team will try their best to help.  
• Under normal circumstances, goods ordered will be delivered to customers in 1-2 working days from the date of order, depending on the requested area of delivery. Delivery service already scheduled shall not be available when Typhoon Signal No.8 or above or when rainstorm warning signal black is hoisted, or in the event of force majeure. An alternative delivery date shall be arranged.
• Customers are required to pay an extra HK$30 per floor (charged from 1/F onwards) for any delivery made to a building without a lift, or when items to be delivered cannot fit in or be transported by the lift.
• Except for cases described below, customers are entitled to our free delivery service when they make a purchase of US $3,000 or above.
• Customers are required to pay an extra charge of HK $300 per delivery to Ma Wan, Tung Chung and Discovery Bay Districts. 

 
4. Return Policy 

• All goods and products must be returned within 30 days of delivery. 

 
5. Privacy Policy 

•  When you shop with Artisan & Blooms, you are required and agree to furnish us with your personal data. If the personal data is incomplete or incorrect, we may not be able to provide desired service to you.
•
Artisan & Blooms shall keep customers' personal data confidential at all times and shall fully observe the Personal Data (privacy) Ordinance of the United States, Europe & Hong Kong SAR ("Ordinance") in collecting, marinating and using customers' personal data. In particular, we observe the following principles:
o personal data is collected for the purposes of sales of products, provisions of related services and customer services
o practical steps are taken to ensure the accuracy of personal data, protected against unauthorized access, and retained for a reasonable period of time.

6. Use of Cookies 
•  Artisan & Blooms uses cookies to store a small piece of data, which will save a returning customer from entering their email address during shopping. Home Essentials does not store personal data in the cookies. If you want to disable the cookies, you may do so by changing the respective settings on your web browser.

 
7. Linked Website 
•  This site may contain links to other websites, which are not maintained, controlled or endorsed by Home Essentials and for which Home Essentials is not responsible. When you access any of these links you access at your own risk for which we disclaim any responsibilities and liability.

 
8. Disclaimer of Warranties and Limitations of Liabilities 
•  This site, and any contents of this site, is provided on an "as is" basis. To the extent permitted by the applicable law, we make no representations or warrants of any kind, express or implied, as to the operation of this site or contents or products included on this site. We do not warrant that this site or emails by us are free of viruses, Trojan Horses, worms or other harmful items. Artisan & Blooms is not liable for any damages of any kind arising from the use of this site. If any provisions of these disclaimers or exclusions shall be lawful, void or unenforceable, that provision shall be deemed servable and shall not affect the validity and the enforceability of the remaining provisions.
 
 
9. Copyright and Trade Marks 
•  Artisan & Blooms and other parties own the trade marks, service marks, product names and logos displayed on this site. Any persons are prohibited from using them without prior written consent of Home Essentials or such other parties. Contents of this site and software incorporated herein are protected by copyright held by or licensed to us and may not be reproduced, stored in a retrieval system, disrupted or used in any way for commercial purposes without our prior written consent.

 
10. Applicable Law 
•  The laws of the Hong Kong Special Administrative Region shall govern the interpretation of these terms and conditions and resolution of any dispute that may arise as a result of usage of this site. If there is any difference between the English language text of the terms and conditions and the Chinese language text, the English version shall prevail.

13. Payment Methods
•  Credit Account: In the event that you have a corporate account with either Artisan & Blooms or Eureka, Artisan & Blooms will send you a welcome email with your user name, password, and credit amount. Said amount will be displayed in the Explorer Pass in the upper right hand corner of your account. Each and every purchase will be deducted from the Pass. 
• Credit Card: You may pay by credit card no matter which ordering method you use (internet or phone). At the time your order is placed, Home Essentials obtains a pre-approval from the credit card company for the amount of your order. Credit card billing occurs when your order ships. Home Essentials accepts American Express, Union Pay, EPS, Visa & MasterCard.
•
Please Note: Debit Cards and Check cards have daily spending limits that may substantially
delay the processing of your order. 
• Credit Card Security Codes Home Essentials requires the credit card security code for your card for any telephone or online purchase. The credit card security code is an individual three or four digit number specific to your credit card that may be printed on the back of your card, on the signature panel (if Visa, MasterCard). Asking for and confirming your credit card's security code helps validate that you - and only you - are in possession of your credit card and protects you from unauthorized use of your account.
• Cash or Check Payment: Artisan & Blooms accepts cash and personal checks from any bank in the US, Europe or Hong Kong. Artisan & Blooms prefers you make this payment at any Home Essentials (33 Lyndhurst Terrace, Central, Hong Kong).
• Multiple Payment Tenders: You may use multiple payment tenders on anything sold by Artisan & Blooms. Split payment orders can be made no matter which ordering method you use (internet or phone). You can pay with two credit cards by indicating the amount to place on your primary card. The remaining balance will be allocated automatically to the second card.
• Explorer Pass Gift Card: You can redeem an Explorer Pass Gift Card in retail Artisan & Blooms, from the Online Home Essentials, by sending a check to Customer Service, or by calling 14043607107. Explorer Pass Gift Cards can only be used in Hong Kong. You can purchase just about anything sold by Home Essentials (except another Explorer Pass Gift Card) including products from Home Essentials. In retail stores, simply present the card to the cashier at time of payment. For online purchases enter the 16-digit card number PIN (to be scratched off). Please keep the card in your possession until the order has been processed and delivered. The Explorer Pass Gift Card is subject to applicable terms and conditions. 
• Wire Transfer: Home Essentials accepts bank wire transfers as valid form of payment. If you would like to use a wire transfer to pay for your order, please contact Customer Service. Processing time varies among banking institutions and can be delayed. Please allow one business day for the processing of your wire transfer.

 
14. Deliveries
•  Signature Required for Deliveries: Most of our shipments contain valuable items. If you will not be at the shipping address to accept delivery of your product, consider shipping the item to an address where someone you trust will be available to sign for your package. Please note that we are not able to adjust a shipping address once a package has left Home Essentials' warehouse. Title and Risk of Loss will pass to you on delivery.
•
Undeliverable Items: Occasionally packages are returned to us as undeliverable. When a carrier returns an undeliverable package to us, please contact us to make arrangements for reshipment.
 
 
15. Order Processing:
•  The estimated shipment date on your order is based on product availability, payment processing time, and warehouse processing time and does not include transit time. Payment process will not begin until we receive all the information we need and full payment or a full authorization, in the case of credit card and lease orders.
•
Orders placed on the weekend or on a holiday will begin payment processing the next business day.

 
16. Prices:
• 
Artisan & Blooms endeavors to offer you competitive prices on current all products. All prices are final. Should you see the same product offered at a lower price at any other time, we apologize. There will not ever be a refund, credit, or similar compensation for price variations.
 
 
 
17. Product Availability:
• 
Order lead time is the length of time it will take us to validate your credit card, assemble the right products, and package your order. Shipping time is the length of time it will for the packages to travel from our warehouse to your shipping address. Home Essentials makes every effort to ship your product according to the estimated lead times provided by Home Essentials at checkout. The estimated lead times are in business days (Monday through Friday) excluding Public Holidays. Lead times will begin the following business day for orders placed and credit cleared after 2pm CST. Lead times quoted on the checkout page are for orders that are partially shipped - meaning items ship as soon as they are available. If you have requested a complete shipment, please add 3-4 additional days for transportation and order consolidation processing.
• Although every effort is made to ship your order according to the lead time provided, shipping dates may change due to changes in supply. If the lead time changes, Home Essentials will contact you via email and provide a revised shipping estimate.
• Given the popularity of some products, Artisan & Blooms may restrict the number of such items that you may purchase. Any product limit restrictions will be posted on Artisan & Blooms web site. This information is subject to change.


 
18. Other Terms and Conditions
 
• Artisan & Blooms is not responsible for typographical errors.
• Artisan & Blooms reserves the right to change the terms and conditions of sale at Home Essentials at any time.
• All sales at Artisan & Blooms Store are governed by Hong Kong Law. 
• No Home Essentials employee or agent has the authority to vary any Home Essentials Store's policies or the terms and conditions governing any sale.


 
19. TERMS OF SALE
 
• Hong Kong SALES ONLY Purchases from Home Essentials are available only in Hong Kong and are not available in any other location.
• SALES TO END USERS ONLY Home Essentials sells products to end user customers only.
 
 
20. TERMS OF SERVICE
 
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND HOME ESSENTIALS (HK) LIMITED ("HOME ESSENTIALS") STATING THE TERMS THAT GOVERN YOUR USE OF THE HOME ESSENTIALS STORE SERVICE. THIS AGREEMENT-TOGETHER WITH ALL UPDATES, ADDITIONAL TERMS, SOFTWARE LICENSES, AND ALL OF HOME ESSENTIALSS RULES AND POLICIES- COLLECTIVELY CONSTITUTE THE "AGREEMENT" BETWEEN YOU AND HOME ESSENTIALS. TO AGREE TO THESE TERMS, CLICK "AGREE". IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CLICK "AGREE", AND DO NOT USE THE SERVICE. YOU MUST ACCEPT AND ABIDE BY THESE TERMS AS PRESENTED TO YOU: CHANGES, ADDITIONS, OR DELETIONS ARE NOT ACCEPTABLE, AND HOME ESSENTIALS MAY REFUSE ACCESS TO THE HOME ESSENTIALS STORE FOR NONCOMPLINCE WITH ANY PART OF THIS AGREEMENT. 

1  Definition of the Home Essentials is the provider of the Home Essentials Store (the  "service") that permits you to purchase under certain terms and conditions as set forth in  this Agreement. 
 
2 Age requirements for use of this service. This Service is available for individuals aged  18 years or older. If you are 18 or older, you should review these terms and conditions with  your parent or guardian to make sure that you and your parent or guardian understand these  terms and conditions.
 
3 Policies and Rules. Your use of the service & purchases made through it are subject Terms  of Sale.
 
4 Your information. You agree to provide accurate, current, and complete information  required to register with the Service and at other points as may be required in the course  of using the Service ("Registration Data"). You further agree to maintain and update your  Registration Data as required to keep it accurate, current, and complete. Home Essentials  may  terminate your rights to any or all of the service if any information you provide is  false,  inaccurate, or incomplete.
 
5 Purchase of Home Essentials Content
 
a  Product Requirements. You acknowledge that use of products may require the use of other    hardware and software products (e.g., the ability to make copies of products on physical  media and render the performance of products on authorized digital player devices), and that  such hardware and software is your responsibility. Once a product is purchased and you  receive the product, it is your responsibility not to lose, destroy, or damage the product,  and Home Essentials shall be without liability to you in the event of any loss, destruction,  or damage. 
 
b Use of Products. You acknowledge that products contain security technology that limits your usage of products to the following Usage Rules, and you agree to use products in compliance to such Usage Rules.
 
c You agree that your purchase of products constitutes your acceptance of and agreement to  use such products solely in accordance with the Usage Rules, and that any other use of the  products may constitute a copyright infringement. The security technology is an inseparable  part of the products. The Usage Rules shall govern your rights with respect to the products,  in addition to any other terms and rules that may have been established between you and  another party. Home Essentials reserves the right to modify the Usage Rules at any time.
 
d You acknowledge that some aspects of the service, products, and administering of the Usage  Rules entails the ongoing involvement of Home Essentials. Accordingly, in the event that  Home Essentials changes any part of the service or discontinues the service, which Home  Essentials may do at its election, you acknowledge that you may no longer be able to use  products to the same extent as prior to such change or discontinuation, and that Home  Essentials shall have no liability to you in such case.

The service may offer interactive features that allow you to, among other things, submit  or post information, materials or links to third party content on areas of the service  accessible or viewable by other users of the service and the public. You represent and agree  that any use by you of such features, including any information, materials or links  submitted or posted by you, shall be your sole responsibility, shall not infringe or violate  the rights of any other party or violate any laws, contribute to or encourage infringing or  otherwise unlawful conduct, or otherwise be obscene, objectionable or in poor taste, and  that you have obtained all necessary rights, licenses or clearances. You further agree to  provide accurate and complete information in connection with your submission of posting of  any information or materials on the Service. Moreover, you herby grant Home Essentials a  worldwide, royalty-free, non-exclusive license to use such materials as part of the Service,  and in relation to products, without compensation or obligation to you. 
 
Home Essentials reserves the right not to post or publish any materials, and to delete, remove or edit any material, at any time in its sole discretion without notice or liability. 
 
Home Essentials has the right, but no obligation, to monitor any information and materials submitted or posted by you or otherwise available on the Service, to investigate any reported or apparent violation of this Agreement, and to take any action that Home Essentials in its sole discretion deems appropriate, including, without limitation, under section below or under our Copyright Policy

 
21. Usage Rules
 
• Your usage of the products is conditioned upon your prior acceptance of the terms of this    Agreement.
• You shall be authorized to use the products only for personal, noncommercial use.
• You agree that you will not attempt to, or encourage or assist any other person to,    circumvent or modify any security technology or software that is part of the service or used  to administer the Usage Rules
• The delivery of products does not transfer to you any commercial or promotional use rights  in the products.
